Minutes of The Village Board of Trustees Meeting held January 9, 2017
Call to Order: 9:00PM. Pledge of Allegiance.
Members Present: Trustee Alan Higgins and Trustee Michael Tancredi

Approval of Minutes: Approved minutes of The Village of Hunter Board of Trustees meeting held December 12, 2016.
New Business:
Bond Resolution – A motion was made by Trustee Tancredi to adopt the Bond Resolution for purchase of used fire truck. Motion was seconded by Trustee Higgins. Resolution 2017-001.
Light Pole Insurance – Treasurer Hilbert requests approval to switch insurance for light poles from Acadia ($3,362) to NYMIR (approximately $460) for an annual savings of approximately $2,902. Motion made by Trustee Tancredi; seconded by Trustee Higgins. All members voting in favor. Motion carried.
Maximum Income Limits for Tax Exemptions for Senior Citizens – Workshop scheduled 4:00PM, January 18, 2017. Public Hearing scheduled 4:00PM, January 26, 2017 followed by Special Meeting at 5:00PM to amend Local Law No. 7 of 1993.
Maximum Income Limits for Tax Exemptions for Persons with Disabilities – Workshop scheduled 4:00PM, January 18, 2017. Public Hearing scheduled 4:15PM, January 26, 2017 followed by Special Meeting at 5:00PM to amend Local Law No. 2 of 2004.
Local Law for Veteran Exemptions – Workshop scheduled 4:00PM, January 18, 2017. Public Hearing scheduled 4:30PM, January 26, 2017 followed by Special Meeting at 5:00PM to adopt local law.
Local Law to override the tax levy limit established in New York General Law 3-C – Limit Upon Real Tax Levies by Local Governments – Workshop scheduled 4:00PM, January 18, 2017. Public Hearing scheduled 4:45PM, January 26, 2017 followed by Special Meeting at 5:00PM to adopt local law.
Village polling place and hours – Resolution 2017-002.
Worker’s Compensation – Charles Sweet – Claim No. 216-0256241
Delaware Engineering, D.P.C. – Invoice dated December 15, 2016 from J. Fraine in the amount of $720.00 for the inspection of sewer lines of the Fyodorov doublewides on Dolan’s Lane. Bill to be paid by the Fyodorovs.
Old Business:
58 Maple Avenue – Building Inspector issued Violation Notice on December 29, 2016. He subsequently issued Building Permit No. 01-17 on January 5, 2017 in the amount of $150.00 for the replacement of the exterior siding, trim and roof with work to begin on or about March 15, 2017.
Doublewides on Dolans Lane – Sestilio Botti asked to be brought up to date. Trustees Higgins and Tancredi gave a brief synopsis of discussions and actions of the last few meetings. Guido Giuliani – Who gave them the permit? Trustee Tancredi – Dominick Caropreso, the Building Inspector/Code Enforcement Officer. Daniela Goldberg – Fire Dominick. Change the Building Inspector. Harold Goldberg – It was not for the Planning Board to review. It was not for us to approve the residences. Trustee Higgins – You should have. You review signs. Harold Goldberg – Yes, under the Sign Law. Trustee Higgins – You do use the Sign Law and its amendments to review signs. But, you do not look at architectural review based on the Architectural Review Law of 2002 which identifies anything on Main Street including residential. Harold Goldberg – Not for a single residential. Trustee Tancredi – It says that – anything on Main Street including residential. Trustee Higgins – So, you do not review the Architectural Review Law the same way you review the Sign Law? Trustee Tancredi – So, I was told that Dominick called the Planning Board Chairman and asked if this was allowable and Paul Slutzky said it was okay. Also, if it was a modular, didn’t you want to see the cut sheets? Didn’t you want to see what it looks like? The elevations? Harold Goldberg – They showed us the cut sheets. Trustee Tancredi – Okay, you saw the cut sheets and nobody picked up that it was a manufactured home and not a modular home? I think the cut sheets look quite different.
Cardboard Box Hotel – Harold Goldberg – Have the engineer’s recommendations been followed? Attorney Gardner – Dominick has told me that the engineer’s recommendations have substantially been followed.
Church – Harold Goldberg – The church is falling down. What is happening with the church? Trustee Higgins relayed information regarding persons interested in the building and stated that we are moving forward. Trustee Tancredi – There are some people that are actually interested in the church.
Correspondence:
495 Productions Holdings, LLC – Trustee Higgins read Letter of Intent sent via e-mail on December 28, 2016 from Ruby Cantu, Production Manager. Attorney Gardner – At no time will we use the word “approved” in a letter we send to them. We acknowledge that we have been advised by them that they will be here. We have no objection to their being here. We welcome them to the community. That if they plan on being on any Village owned property they will need specific approval for that if and when they request it. They have to request it and then it will be considered and also then we will ask them that they not be in Colonel’s Chair as the roads are narrow and it would cause too much congestion. Trustee Higgins – We will work on that letter.

A motion was made by Trustee Higgins to enter into Executive Session; seconded by Trustee Tancredi.
Trustee Higgins – We have returned from Executive Session.
A motion was made by Trustee Tancredi to hire Matthew Edwards starting at $12 per hour for the vacant highway position to commence at the first available start date. Motion was seconded by Trustee Higgins. All members voting in favor. Motion carried.

Resolution 2017-001
The following resolution was offered by Trustee Tancredi, seconded by Trustee Higgins, to wit;
BOND RESOLUTION DATED JANUARY 9, 2017
A RESOLUTION AUTHORIZING THE PURCHASE OF A FIRE PUMPER TRUCK AND AUTHORIZING THE ISSUANCE OF SERIAL BONDS OF THE VILLAGE OF HUNTER, GREENE COUNTY, NEW YORK IN THE AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $200,000 PURSUANT TO THE LOCAL FINANCE LAW TO FINANCE SAID PURPOSE AND DELEGATING THE POWER TO ISSUE STATUTORY INSTALLMENT BONDS OR BOND ANTICIPATION NOTES IN ANTICIPATION OF THE SALE OF SUCH BONDS TO THE TREASURER
BE IT RESOLVED, by the Village Board of Trustees of The Village of Hunter, Greene County, New York (the “Village”) (by the favorable vote of not less than two-thirds of all of the members of the Board), as follows:
Section 1: The specific purpose (hereinafter referred to as “purpose”) to be financed pursuant to this resolution is the purchase of a fire pumper truck with 8-person cab, 3” deluge gun, foam system with a minimum 20-gallon tank and 2000 gallon per minute pump. The maximum cost of said purpose shall not exceed $200,000.
Section 2: The plan for the financing of such maximum cost is by issuance of $200,000 Serial Bonds (Village of Hunter Fire Pumper Truck), Series 2017 (the “Bonds”) of The Village of Hunter and is hereby authorized to be issued therefore pursuant to the Local Finance Law of the State of New York.
Section 3: It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is twenty (20) years, pursuant to subdivision 27 of paragraph (a) of Section 11.00 of the Local Finance Law of the State of New York. The bonds to be issued pursuant to this resolution will have a maturity date of ten (10) years.
Section 4: The Village has determined that the purchase and financing of The Village of Hunter Fire Pumper Truck is an “unlisted” action that will not have a significant effect on the environment and, therefore, no other determination or procedures under the State Environmental Quality Review Act (“SEQR”) is required.
Section 5: The proceeds of the Bonds herein authorized and any bond anticipation notes issued in anticipation of said Bonds may be applied to reimburse the Village for expenditures made after the effective date of this resolution for the purpose for which said Bonds are authorized. This resolution shall constitute a statement of official intent for purposes of Section 1.150-2 of the Treasury Regulations.
Section 6. Each of the Bonds authorized by this resolution and any bond anticipation notes issued in anticipation of said Bonds, shall contain the recital of validity prescribed by Section 52.00 of the Local Finance Law. The faith and credit of the Village are hereby irrevocably pledged for the payment of the principal of and interest on said bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on said Bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property of the Village a tax sufficient to pay the principal of and interest on said Bonds as the same become due and payable.
Section 7. Subject to the terms and contents of this resolution and the Local Finance Law, and pursuant to the provisions of Sections 30.00, 50.00 and 56.00 to 63.00, inclusive, of said Law, the power to authorize bond anticipation notes in anticipation of the issuance of the Bonds authorized by this resolution and the renewals of said notes and the power to prescribe the terms, form and contents of said serial bonds and said bond anticipation notes (including without limitation the date, denominations, maturities, interest payment dates, consolidation with other issues, and redemption rights), the power to determine to issue said Bonds providing for substantially level or declining debt service, and the power to sell and deliver said Bonds, (including statutory installment bonds), and any bond anticipation notes issued in anticipation of the issuance of such Bonds, is hereby delegated to the Treasurer, the Chief Fiscal Officer of the Village. The Treasurer is hereby authorized to sign any Bonds issued pursuant to this resolution and any bond anticipation notes issued in anticipation of the issuance of said Bonds, and the Village Clerk is hereby authorized to affix the corporate seal of the Village to any of said Bonds or any bond anticipation notes and to attest such seal.
Section 8. The Treasurer is further authorized to take such actions and execute such documents as may be necessary to ensure the continued status of the interest on the Bonds authorized by this resolution, and any notes issued in anticipation thereof, as excludable from gross income for federal income tax purposes pursuant to Section 103 of the Internal Revenue Code of 1986, as amended (the “Code”) and, to the extent applicable, to designate the bonds authorized by this resolution and any notes issued in anticipation thereof as “qualified tax-exempt bonds” for purposes of Section 265(b)(3)(B)(I) of the Code.
Section 9. The validity of said Bonds or of any bond anticipation notes issued in anticipation of the sale of said Bonds may be contested only if:
(1) Such obligations are authorized for an object or purpose for which the Village is not authorized to expend money; or
(2) The provisions of law which should be complied with at the date of the publication of this resolution are not substantially complied with;
and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication; or
(3) Such obligations are authorized in violation of the provisions of the Constitution of New York.
Section 10. Following the effective date of this resolution, the Village Clerk is hereby authorized and directed to publish this resolution, or a summary thereof, together with a notice in substantially the form provided by Section 81.00 of the Local Finance Law, in The Daily Mail, being a newspaper having a general circulation in the Village and hereby designated as the official newspaper of the Village for such publication.
Section 11. This resolution is subject to a permissive referendum of the qualified electors of the Village pursuant to Local Finance Law Section 36.00.
The question of the adoption of the foregoing resolution was duly put to vote on a roll call, which resulted as follows:

To the extent required by law or said regulations, due and proper notice of said meeting was given. A legal quorum of members of the Village Board of Trustees was present throughout said meeting, and a legally sufficient number of members (two-thirds of the Village Board of Trustees) voted in the proper manner for the adoption of the resolution. All other requirements and proceedings under law, said regulations or otherwise incident to said meeting and the adoption of the resolution, including any publication, if required by law, have been duly fulfilled, carried out and otherwise observed.
(4) The seal appearing below constitutes the official seal of the Village and was duly affixed by the undersigned at the time this certificate was signed.

Resolution 2017-002
The Village of Hunter Election
Election Polling Place and Hours
Motion made by Trustee Tancredi; Seconded by Trustee Higgins.
RESOLVED that The Village of Hunter Board of Trustees orders the polling place for The Village Election of Tuesday, March 21, 2017, be the Hunter Village Hall at 7955 Main Street (Route 23A), Hunter, New York 12442 and orders the polls be open from 12:00Noon to 9:00PM.
The foregoing resolution was put to a vote and was carried unanimously.
Trustee Alan Higgins voting – yea.
Trustee Michael Tancredi voting – yea.
The resolution was thereupon declared duly adopted.
