Minutes of Meeting held January 11, 2016

Call to Order: 8:00PM. Pledge of Allegiance

Members Present: Mayor William Maley, Trustee Alan Higgins and Trustee Michael Trancredi

Also Present: Larry Gardner, Village Attorney, Charles Sweet, Superintendent of Highways, John LaVeglia, Gary Slutzky, Gary Goodrich and John Murphy of the Hunter Fire Company No. 1 and Kathleen M. Hilbert.

Public Present: Robert Hamley, Fritze Martin, Lou Schmidt, Jim P. Planck, Jim Ray, Chuck Tomajko and Harold Goldberg

Bid Opening for Fire Apparatus:

KME-Kovatch Organization – $420,957.00

Rosenbauer America/Garrison Fire & Rescue Corp. – $399,598.00

Privilege of the Floor:

New Business:

Mountaintrail at Hunter, LLC – Application for water service and $1,500 application fee has not been received. Attorney Gardner will contact the principal. Attorney Gardner has been told that they have retained an attorney for the annexation petition.

Property Tax Cap Law – No action taken. Public Hearing to be held at 8PM on February 8, 2016.

Old Business:

SCBAs – John LaVeglia, Hunter Fire Company No. 1 mentioned specs for SCBAs that were previously dropped off by the Assistant Fire Chief. At a structure fire last week three SCBAs became unusable. He was not sure why, was it because of the cold weather – it was four degrees, or because of the age of the packs. He has been told the life span of these packs is about fifteen years. Air packs are very important in the fire business and they need them yesterday. The Mayor stated the Clerk will put this out to bid. Mr. LaVeglia would like to request that bids be received in four weeks. Trustee Higgins would like to set up a special meeting to open the bids. This will be done as soon as is legally possible.

Noise Ordinance – Chuck Tomajko. Attorney Gardner has called every attorney who could prosecute this case and of those attorneys who could, no one will. The Mayor stated that we are now looking outside of the county. We may have one possibility. It is very distressing because issues like this are hard to prosecute and most attorneys do not want to get involved. Mr. Tomajko states we are coming up on spring soon, it is going to rear its ugly head again, they are converting the house across the street from him into some type of rental, so he is starting to see other issues and he wants to get something settled so that people understand that there are ramifications for improper activity. Can we approach the County Attorney? It has been seven months. Is it going to go a year before it is prosecuted? He is sure the poor guy next door also wants to bring this to closure. Attorney Gardner has approached the County Attorney who suggested an attorney in Canajoharie. The Mayor explained to Mr. Tomajko that the Village has not dropped the ball on this issue. Mr. Tomajko wants to get something done. To live next door to this guy and every day to have this edge and to have guests and are they going to complain, is it going on trip advisor. He has a huge investment and he is becoming very impatient and he thinks that the surrounding neighbors probably have a similar vested interest. Attorney Gardner will call the Attorney in Canajoharie. Mr. Tomajko would like to know if there is a way of communicating with him about the progress of this issue without him coming to meetings. Mayor requested Mr. Tomajko to give the Clerk his e-mail address.

Frank Raho (Cardboard Box Hotel) – Attorney Gardner stated that at the last meeting we determined that if he made significant progress before the January meeting, we would take that into consideration; and in the absence of progress we would take action against him. Attorney Gardner drove to the site on Saturday and nothing has been done. He will contact Mr. Caropreso and schedule a court date.

Correspondence:

  1. Safety Person of the Year Nomination – Letter from PERMA dated December 11, 2015. No action taken.
  2. NYS Federal Property Assistance Program – Letter and application from Office of General Services dated December 22, 2015. Nothing has changed. Send in information.
  3. Flood Hazard Mitigation – Letter dated January 2, 2016. We applied for funds but were denied.
  4. Catskill Watershed Corporation Notice of Preliminary Decisions dated January 6, 2016, referencing the actions of the CWC Board of Directors at their meeting held January 5, 2016.
  5. Record Retention – Letter from Willkie Farr & Gallagher LLP dated January 5, 2016. We must have these records returned to us.
  6. Red Cross Training – E-mail dated January 11, 2016. Shelter Fundamental Training Class offered free of charge by the Red Cross will be held at the Windham Waste Water Treatment Plant on Saturday, January 16, 2016 from 8:30AM to 1:00PM – limit of four persons from each town/village.
  7. E-mail dated January 11, 2016 with agenda for MCSB meeting to be held 9:30AM January 14, 2016 at WAP office located at 6049 Main Street in Tannersville.

Resolutions:

Resolution 2016 – 001
The Bank of Greene County – Official Bank

Motion made by Trustee Michael Tancredi; Seconded by Trustee Alan Higgins

RESOLVED that the Village of Hunter Board of Trustees hereby designates The Bank of Greene County as the official bank for The Village of Hunter.

The foregoing resolution was put to a vote and was carried unanimously.

Resolution 2016 – 002
The Daily Mail – Official Newspaper

Motion made by Trustee Michael Tancredi; Seconded by Trustee Alan Higgins

RESOLVED that the Village of Hunter Board of Trustees hereby designates The Daily Mail as the official newspaper for The Village of Hunter.

The foregoing resolution was put to a vote and was carried unanimously.

Resolution 2016 – 003
Maximum Income Limits for Tax Exemptions for
Senior Citizens and Disabled Citizens

Motion made by Trustee Michael Tancredi; Seconded by Trustee Alan Higgins

RESOLVED that The Village of Hunter Board of Trustees adopts a maximum income limit of $24,500 for a 50% tax exemption for senior citizens with no sliding scale and a maximum income limit of $16,000 for a 50% tax exemption for disabled citizens with no sliding scale for the calendar year 2016.

The foregoing resolution was put to a vote and was carried unanimously.

Resolution 2016 – 004
Election Polling Place and Hours

Motion made by Trustee Michael Tancredi; Seconded by Trustee Alan Higgins

RESOLVED that The Village of Hunter Board of Trustees orders the polling place for the Village Election of Tuesday, March 15, 2016, be The Hunter Village Hall at 7955 Main Street (Route 23A), Hunter, New York 12442 and orders the polls be open from 12:00Noon to 9:00PM.

Resolution 2016 – 005
Appointment of Village Election Inspectors

Motion made by Trustee Michael Tancredi; Seconded by Trustee Alan Higgins

RESOLVED that The Village of Hunter Board of Trustees appoints Susan Holcomb as Village Election Inspector Chairperson at the rate of $120 per day and appoints Christine Kohler and Mary O’Connor as Village Election Inspectors at the rate of $110 per day for the Village Election to be held on Tuesday, March 15, 2016 between the hours of 12:00Noon and 9:00PM at The Hunter Village Hall.

Central Hudson Gas and Electric Corporation
Street Lighting Authority Order

Motion made by Trustee Michael Tancredi; Seconded by Trustee Alan Higgins

RESOLVED that The Village of Hunter Board of Trustees authorizes Central Hudson Gas and Electric Corporation to remove the street light on pole number 126083.

The foregoing resolution was put to a vote and was carried unanimously.
